Terms and ConditionsPAYMENTS: Payments can be made by: Visa, Mastercard or Discover. Check payments mail directly to: Five Star Vacation Homes 1420 Celebration Boulevard, Suite 200 Celebration, Florida 34747 Checks may only be accepted after discussed with a Five Star Vacation Homes representative. RESERVATIONS AND DEPOSITS: All reservations require a 20% payment to hold chosen dates. 49 days prior to arrival the remaining balance is due in full. CANCELLATION POLICIES: All cancellations must be received in writing and are subject to the following penalty percentages of the total rental fee:
Five Star Vacation Homes regrets that they are unable to waive any of the cancellation charges above, whatever the circumstances. Please consider trip insurance against unforeseen cancellations of your Florida vacation. RESERVATION PRICES DO NOT INCLUDE: Expenses and items not mentioned, including, but not limited to: transportation, tips for personal services, meals, insurance, telephone calls and other items of a personal nature. CHANGE TO BOOKINGS: If you wish to make a change to your reservation, there will be an additional processing fee of $25.00 per change. SECURITY DEPOSIT: A refundable security deposit in that amount of two hundred dollars ($200.00) is required for each and every reservation. Every reservation must have a credit card of file for incidentals and the security deposit in the amount mentioned above will be processed within forty-eight (48) hours prior to check in. So long as the property, the contents and all related items are in the same condition as they were upon check in, the deposited will be credited back within forty-eight (48) hours after your check out, providing the above as well as the following provisions are met:
MAXIMUM OCCUPANCY: Each property has a legal maximum of persons allowed as determined by a local official. If you are unsure of the maximum guests allowed in a particular property, please do not hesitate to ask. A complete guest list is required for each reservation. IMPORTANT INFORMATION: The following are deemed understood by the guest:
RESPONSIBILITY: Tenant hereby assumes all risk of damage to any and all personal property of Landlord and Tenant, including household furniture and goods during such use and occupancy. Tenant hereby assumes any and all risks associated with the foregoing and agrees to hold Landlord harmless from and indemnify Landlord against the same. USE: It is agreed that the Premises shall be used only for residential, vacationing purposes, no animals and for no other purpose whatsoever. Tenant in his possession, use and occupancy of the Premises agrees to observe and comply with all restrictions, laws and ordinances affecting the Premises or occupancy thereof. Tenant further agrees that no use shall be made of the Premises, or acts done which will increase the existing rate of insurance upon the Premises, or will cause a cancellation of any insurance policy covering the Premises. Smoking is not permitted in any residence. A $500.00 fee may be charged for ionization, if smoking in the property is detected. POOL/SPA DISCLAIMER/ASSUMPTION OF RISK : There is no lifeguard on duty. Persons using the pool and/or spa do so at their own risk and owners and management assume no responsibility for accident or injury. The property is equipped with a pool and a spa heated by an electric heat pump; when heated the maximum temperature is 85°. Please understand that it is not possible to guarantee the temperature of the pool which to some degree is dependent on the local weather. Guests should note that electrically heated pumps will warm a pool on a Floridapool home to the operating temperature of 75-85 degrees Fahrenheit in 24-48 hours - depending upon the ambient air temperature. Electrical pool heaters utilize a heat exchange pump. If the outside temperature at your vacation home drops below 60 degrees Fahrenheit, then the poolheater will not operate, and the pool will not be heated. If the overnight temperature drops below 55 degrees, the pool may not be able to return to the operating temperature range during the following day. Guests should also note that spa pools provided on vacation homes with electricheat pumps are not hot-tubs, and are not always designed to heat higher than the temperature of the pool. All should note that pool heat cannot be guaranteed, as sometimes mechanical devices fail, or environmental factors will not allow the pools to be heated. Guests must notify the owner of failure of pool heat on the day of occurrence, so that the temperature or the equipment can be checked by personnel. Owners will do their best to keep it operational; however, they cannot guarantee its operation all or any of the time of occupancy. Renter(s) should inspect on arrival. Owners will not be responsible to clean the pool/spa during Renter(s) stay; however normal maintenance of pool/spa service will be continued and Renter(s) must allow servicemen entry topool area. LIMITATION OF LIABILITY: Five Star Vacation Homes will put forth all reasonable efforts to provide advice and safety information within the rental unit in the form of both verbal and written communication. It is the responsibility of each guest to ensure that all information and advice that has been provided is completely understood. Any information in addition to that provided can simply be requested by the guest for further explanation. In addition, Five Star Vacation Homes states the following:
« Five Star Vacation Homes and / or said Property Owner and / or said Community / Resort do not accept any liability for any lost of stolen items of a personal nature from the rented property during or after the guest stay and departure. If this is to occur, it is recommend that the guest call the appropriate local authority initially, followed by contacting Five Star Vacation Homes. Five Star Vacation Homes will be of assistance, if requested, at all times during any insurance claim. « The guest understands the vacation community is a vacation resort for most and a homestead community for few. The guest agrees to conduct oneself in an appropriate manner at all times within the resort, including the rental unit and to abide by all resort and association rules, which are available within the Welcome Book. All guests are bound by these rules and if Five Star Vacation Homes is required to be contacted by a neighboring unit, cooperative management company, resort staff or local authority, Five Star Vacation Homes has the right to have any and all guest(s) at specified rental property removed with any form of compensation. |
